Last Powers of Attorney

Lindsey Johnson leads this department and is assisted by Maria Amin solicitor.

Lindsey has over 30 years’ experience in family law work and preparation of Wills plus 10 years’ experience of inheritance claims, administration of estates and mental capacity work. She is a full member of The Society of Trust & Estate Practitioners (STEP) having completed the STEP Administration of Trust & Estates diploma in 2019.

Maria has over 4 years of experience in wills, administration of estates, lasting powers of attorney and deputyship.

We can prepare Lasting Powers of Attorney (LPA) and also make applications for Deputyship orders in the Court of Protection. If you require advice about mental capacity relating to health and welfare and you may be eligible for legal aid we will refer you to another legal provider who has the required legal aid contract.

While you retain your mental capacity we can prepare and register for you :

  • Lasting Power of Attorney for your financial & property affairs £350 + VAT = £420
  • Lasting Power of Attorney for your health & welfare decisions £350 + VAT = £420
  • Both types of LPA together at same time £600 + VAT = £720
  • Registration of Enduring Power of Attorney = £400 + VAT = £480

In addition there are registration fees that you will need to pay directly to the Office of the Public Guardian during the registration process. At present the fee is £82 per Lasting Power of Attorney.

We offer a discount if you make a will and Lasting Power of Attorney(s) at the same time. The discount is £50 per LPA.

Court of Protection/Deputyship

If the person you care for or are concerned about has already lost his or her mental capacity you can apply for a deputyship order in relation to his or her property & financial affairs and thereafter you will need to prepare annual accounts:-

  • A deputyship order for financial & property affairs. For straight forward cases we can limit our costs to the Court of Protection standard fee of £950 + VAT = £1,140 + application fee £371 + mental capacity certificate fee £100 - £750 + bond estimated £100 - £300 total = £1,700 - £2,500. More complex cases will be charged according to time spent at an hourly rate of £170 + VAT per hour.
  • Annual accounts for Deputyship for simple estate £500 + VAT = £600 plus any Court of Protection fees.

Any other types of application such as issues relating to health and welfare decisions or making statutory wills in the Court of Protection will be charged according to time spent at our hourly rates plus VAT plus any fees to others.
