The UK government will repeal the *presumption of parental involvement* from the Children Act 1989 to prioritise children’s safety over automatic parental contact. Evidence shows that assuming contact with both parents is always best but can perpetuate abuse and harm children. Reform follows years of campaigning by Claire Throssell, MBE, whose sons were killed by their abusive father. Her advocacy with Women’s Aid pushed for this critical legal change.
Deputy Prime Minister David Lammy and Justice Minister Baroness Levitt KC stress that *a child’s right to safety* comes before a parent’s right to contact.
Further protection includes the Pathfinder courts to improve family court experiences and plans to restrict parental responsibility for those convicted of serious sexual offences or where a child is born of rape.
Response from Women’s Aid’s Chief Executive Farah Nazeer welcomed the move as “long overdue,” calling for continued reform to challenge the “pro-contact” culture in courts.
What happens now…….legislation to repeal the presumption will be introduced when Parliamentary time allows — marking a key step in protecting children and rebuilding trust in the justice system.
